During more than thirty-five years as a consultant in alcohol test procedures I have appeared as an expert witness more than 500 times, in 25 states, in cases involving driving under the influence (DUI) charges. Two consistent factors in all of these cases involving blood alcohol concentration (BAC) are significant. The measurement of BAC was made on a single sample of blood and the result was reported as a percentage accurate to three decimal points. After a careful examination of the analytical procedures used, the precision actually obtained was often about equivalent to a precise guess. My open letter is my plea for help in an attempt to correct this long-standing inaccurate presentation of blood alcohol test results. Forensic toxicologists, clinical chemists, defense attorneys, prosecution attorneys, judges and the driving public should all be urged to seek the changes needed to correct this serious problem.
